Terms of Service

Before you intend on commissioning art from me,(Bill S., hence forth "the artist") please read the following terms of service. Upon sending me a request (for a commission) you have acknowledged that you have read and are in compliance with this commission terms of service.


Section 1. Payment terms
outlined here is a general, but sometimes changeable under certain circumstances.

Payments will be directly by Paypal in USD unless the situation included in person transfer of payment.

Sketches:
All sketches will be paid for in full before work begins. The only circumstance in which a 50% down, 50% at completion will be considered is when agreed price for the piece is in excess of $40.00 usd. Shipping costs are seperate from this rule, and will be paid at completion as you will be paying for the quality of shipping YOU choose. there are some limits to shipping that will be discussed on a case by case basis.

Digital work:
Inks/ linework will be paid in full before work begins. The only circumstance in which a 50% down, 50% at completion will be considered is when agreed price for the piece is in excess of $40.00 usd. (such as full body flat colors, Thigh up and full body full color.

Traditional work
Due to the nature of traditional works such as watercolor, airbrush, or other mediums, the cost and quality of these items requires greater time and investment by both myself (the artist) and you (the buyer). As such, various payment schedules will exist. On smaller works that will be of lesser cost and or time, it is most likely that a 50% at start, 50% at completion, shipping added at completion pay schedule will be used. In larger, longer, or more complex works, the payment schedule may be along the lines of this example for a detailed watercolor: 30% before work starts, 30% at the time of final approval of the sketch, 30% and shipping at completion.


Section 2. Rights
First and foremost to protect you (the buyer), your Original Character (OC) is the property of its creator, in this case, the buyer. The usage of non OC characters (those from popular works or otherwise not created by the buyer) shall be determined on a case by case manner, such as for the usage of "fan art".

The rights of the work you, the buyer, purchase from me shall be retained by me, the artist. I shall not claim ownership to any OC used unless it is my own, and shall retain the rights to exhibit the work in any format. I shall also retain the rights to reproduce the work for print or to promote myself as I see fit.

You, as the buyer, shall have the right to reproduce the work for personal, non commercial use, To claim ownership of the OC, but not to the work, and you will be required to give credit to me, the artist, for the work.


Subject Matter
1. References should be very clear and any specific requirements/details mentioned.

2. I will happily correct any mistakes, given that they were made on my behalf (e.g. I misread a description), I do try to read/look as closely as possible but I might make a mistake. However if the mistake is as a result of insufficient information (e.g. unclear references, the element is not mentioned prior to me accepting the commission), you cannot force me to correct it. There may be some leniency with whether or not I choose to correct something depending on how clearly/unclearly it was described and the size of the error. However under no circumstances will I redraw a commission.

3.In regards to artistic freedom, I will make stylistic choices if these choices fall under anything you have not specified before we agreed on the commission. If you would like me to use the exact colors from a reference please tell me, because I tend to stray slightly from exact colors so that the image seems more harmonious. I have a few styles of illustration that I work in, so there is some range to what I can do in those regards.

4. If you are commissioning a character that belongs to someone else, I would like a confirmation that you have permission to do so. This is a rather vague condition because I know that sometimes people might want to commission surprise gift art but on the flip side, I definitely do not approve of commissions of stolen designs. Since this is so ambiguous, if you are commissioning a character that isn't yours, please inform me.

5. I will not draw in any styles that are not being offered at that moment in time whether they be mine or any other styles (e.g. other styles from specific cartoons or other artists styles.)

6.Since I don't really have a list of things I will or won't draw, I reserve the right not to take commissions for what ever reason, specified or unspecified. For instance if I find it is not within my ability or I simply do not want to draw it. However you are welcome to ask me whether I will or won't draw something.
